Understanding Rental Restrictions in Sarasota County: A Must-Know for Investors

If you're an investor eyeing Sarasota County for its lucrative vacation rental market, it's essential to understand the local rental restrictions that could impact your plans. Sarasota County and the city of Sarasota have distinct rules governing short-term vacation rentals, and compliance is crucial for anyone looking to turn a property into an Airbnb or VRBO.

Sarasota County Restrictions

Sarasota County enforces a general prohibition against leases of less than 30 days for single-family and multi-family properties in unincorporated areas. The only exception to this rule is for multi-family properties located on the barrier islands—Siesta Key, Casey Key, and Manasota Key—where short-term rentals are permitted.

For investors, this means that unless your property is a multi-family unit on one of these barrier islands, you won't be able to legally rent it out for periods shorter than 30 days. This restriction can significantly limit your ability to generate income from short-term vacation rentals in most parts of Sarasota County.

City of Sarasota Regulations

The city of Sarasota offers more flexibility, allowing short-term rentals with a minimum lease duration of one week. However, properties within the Coastal Islands Overlay District (CIOD)—which includes areas like St. Armand’s Key, Coon Key, Bird Key, Otter Key, Lido Key, and parts of Siesta Key—are subject to additional regulations under Chapter 34.5 of the city code.

Owners must obtain a certificate of registration for each vacation rental in the CIOD. This certificate is non-transferable, so if you purchase a vacation rental, you'll need to apply for a new certificate within 15 days of acquiring the property.

Additional requirements include designating a responsible party available 24/7 to address any issues, ensuring the property meets specific safety standards, and posting essential information such as emergency contacts and evacuation instructions within the rental.

Key Takeaways for Investors

  1. Sarasota County: Short-term rentals of less than 30 days are largely prohibited, except for multi-family properties on the barrier islands.

  2. City of Sarasota: Short-term rentals are allowed with a one-week minimum stay, but properties in the CIOD have additional requirements, including obtaining a certificate of registration and complying with safety and informational standards.

Navigating these regulations is essential for protecting your investment and ensuring a successful vacation rental business in Sarasota County. Before purchasing a property with the intent to rent it out short-term, make sure you understand the local laws and requirements to avoid any legal pitfalls.

Whether you're a seasoned investor or new to the Sarasota market, being well-informed about these restrictions will help you make smarter, more profitable decisions.
